Chronus24 Posted August 12, 2010 Report Share Posted August 12, 2010 I am asking this question in regards to one of my guy students/friends, since he has limited internet access: he is considering performing Balanchine's Tchaikovsky Pas De Deux for YAGP this year. However, being a devoted "balanchine" disciple (not my fault, lol...), he is concerned about whether or not "The Trust" (a blessing upon it's name...) would take issue with this. I, unfortunately, am not sure. On one hand, YES, "Tchai Pas" IS a Balanchine ballet, but on the other hand, it is also one of the MOST frequently performed (variations, at least) of ANY of the Balanchine Rep, Trust "Blessing" or not...so, is it to be "understood" that The Trust will let a student perform this for a competition and "let it slide"? Granted, I can assure anyone that he is both perfoming it "truthfully" as well as EXTREMELY well!... Quote Link to comment
Mel Johnson Posted August 12, 2010 Report Share Posted August 12, 2010 Usually in competitions, if a work is a required element of performance, the competition management pre-clears it with the rights holder, but as this is an open selection, the responsibility for getting clearance falls to the performer. YAGP sounds like a "fair use" application, but then, I'm not the Estate, the Trust, the Foundation, or anything else Balanchine™, so best to give them a call and find out for sure.
